I know of two other lawsuits basically concerning the same thing: does AI output trained on other people’s work violate copyright. The existing ones are independent artists sueing about image generation algorithms, but I assume the same concepts will apply here too.

I don’t think a DMCA takedown would suffice, because the AI companies would just send a counter notice and the suit would end up in court anyway. A blanket “please stop doing business” takedown just won’t have any effect.

These lawsuits are going to have a huge effect, unless they all get settled. If the artists end up winning, the AI industry is going to need to scramble to collect a database that they actually have the rights to use (tech billionaires paying for content? preposterous!) or AI will be the escape hatch for anyone looking to plagiarise other people’s work.
